The Appeals Chamber of the International Criminal Court has upheld an appeal by the State of Israel challenging the Jurisdiction of the Court, ruling that the pre-trial Chamber committed an error in law by failing to address Israel’s argument that it was entitled to make a jurisdictional challenge under pertinent articles of Rome Statute.
